Arbitrary depreciation: writing an asset off faster

Willekeurige afschrijving lets you depreciate assets faster. When starters and green schemes qualify, and how to shift profit strategically.

Normal depreciation spreads an asset's cost evenly over its useful life—a laptop over five years, a desk over ten. But Dutch tax law allows freelancers and businesses to depreciate faster under certain conditions, through willekeurige afschrijving (arbitrary or flexible depreciation). This gives you the power to shift profit into high-tax years and unlock tax relief when you need it. Here's when you can use it, and how.

What is willekeurige afschrijving?

Willekeurige afschrijving is the flexibility to depreciate a business asset over a shorter period than its normal lifespan, or to vary the depreciation amount year to year—as long as you stay within a legal minimum and maximum.

Instead of depreciating a laptop over exactly five years (20% per year), you could write it off over three years, or over seven. Instead of a fixed annual deduction, you could deduct heavily in year one, then lightly in years two and three. This flexibility lets you time your tax deductions strategically to match periods when your profit is high.

When can you use flexible depreciation?

You cannot simply write off any asset however fast you like. Willekeurige afschrijving is only available in specific situations:

1. Starters and new entrepreneurs

If you have been running your business for 3 years or fewer, you can use flexible depreciation on assets you acquire during that period. This rule gives young businesses breathing room in their early, often unprofitable, years. After three years, you lose this benefit and must revert to normal (straight-line) depreciation.

2. Green investments and environmental relief (VAMIL)

The Vorderingsregeling Milieubeleggingen Liquiditeitsbevordering (VAMIL) scheme allows accelerated depreciation on certain environmental and sustainability investments. Common examples:

  • Energy-efficient building improvements
  • Renewable energy systems (solar panels, heat pumps)
  • Electric vehicles and charging infrastructure
  • Water-saving equipment

The relief is typically temporary—check with the Belastingdienst or your advisor which investments currently qualify in the year you invest.

3. Temporary government relief schemes

The government sometimes opens short-term depreciation relief for investment (e.g., to stimulate the economy or support sectors hit by crisis). These schemes come and go—you must confirm what is active in your tax year.

How to use flexible depreciation

Let's say you're a freelancer in your second year of business, and you invest €5,000 in a new laptop and software.

Under normal straight-line depreciation:

  • Lifespan: 5 years
  • Annual deduction: €1,000 per year for 5 years
  • Total taxable profit impact: €1,000 annually

Under willekeurige afschrijving (if you're a starter):

  • You could depreciate it over 3 years instead:
    • Year 1: €2,000 deducted
    • Year 2: €2,000 deducted
    • Year 3: €1,000 deducted
  • Or you could vary it per year:
    • Year 1: €3,000 (accelerated)
    • Year 2: €1,500
    • Year 3: €0.50
  • Total is still €5,000, but the timing shifts the deductions forward.

The benefit is clear: if you expect high profit next year, you can defer some deductions this year, then claim more next year when you need the tax relief.

Minimum and maximum depreciation rates

You cannot depreciate less than 20% of the asset's book value each year (the minimum rate), nor extend it over an unreasonably long period. The Belastingdienst applies reasonableness tests. A €5,000 laptop must be gone in a few years, not over 20 years. Always confirm your intended depreciation schedule with your tax advisor before filing.

Interaction with other deductions

Flexible depreciation works alongside other investment reliefs, but there are rules:

  • Willekeurige afschrijving + KIA: You can combine flexible depreciation with the KIA investment deduction—they are not mutually exclusive.
  • Willekeurige afschrijving + VAT recovery: Recovering input VAT on the asset doesn't affect depreciation; both work independently.
  • Starters only once: If you're using the starter's flexible depreciation window (first 3 years), you cannot opt back and forth. Commit to a schedule, and stick to it in your annual return.

When NOT to use flexible depreciation

Flexible depreciation sounds like a tax gift, but it's not always worth using:

  1. Low-profit years: If this year and next year both have low profit, accelerating deductions now won't help—you'll still owe little tax. Save the deductions for when you need them.

  2. Loss years: If you're already making a loss, depreciation deductions don't reduce your tax (losses carry forward). Speed-depreciating an asset wastes a valuable deduction.

  3. Recovery risk: If the Belastingdienst later disallows your depreciation schedule, you'll owe back taxes plus interest. Conservative businesses sometimes stick with standard depreciation to avoid audit risk.

  4. Planned exit or sale: If you plan to sell the asset within a year or two, flexible depreciation may complicate the calculation at sale. The book value must match your depreciation schedule.

Documentation and consistency

Whatever depreciation schedule you choose, you must document it clearly in your business accounts and mention it in your tax return (or notes to your return). You cannot use flexible depreciation in one year, then switch to straight-line the next. Inconsistency signals to the Belastingdienst that you may not have a solid strategy and can trigger an audit.

Practical steps

  1. Check your eligibility: Are you in your first 3 years? Do you have a qualifying green investment? Is a relief scheme active?
  2. Decide your schedule: How much profit do you expect this year and next? Map out when you want the deductions.
  3. Document it: Write down your depreciation policy (asset, cost, schedule, lifespan) in your bookkeeping or a separate memo.
  4. Report it: When you file your income tax return (aangifte inkomstenbelasting), declare your depreciation schedule clearly. Your accountant or tax software should guide this.
  5. Keep consistent: Once filed, stick to the schedule. Changing it mid-stream is risky.

Frequently asked questions

Can I use willekeurige afschrijving for a business car?
Yes, if you qualify (starter, green vehicle, relief scheme). Electric and hybrid cars often qualify under VAMIL. A regular petrol car is eligible only in your starter window. Check the current VAMIL list with the Belastingdienst for which vehicle types qualify in your tax year.
What if I change my depreciation schedule mid-year?
You cannot retroactively change a depreciation schedule in a tax year you've already filed. You can adjust it for future years, but inconsistency may invite scrutiny. Plan your schedule before year-end and stick to it.
Does flexible depreciation reduce my basis for VAT recovery?
No. Depreciation is a tax concept; VAT recovery is based on the actual purchase cost and your business use. Depreciating an asset faster does not affect how much VAT you can reclaim.
I'm past my starter window. Can I still use flexible depreciation?
Only if your asset qualifies under a green-investment scheme (VAMIL) or an active government relief program. Check belastingdienst.nl or your advisor for current schemes. Standard depreciation (straight-line at 20% per year or longer) applies otherwise.
